In accordance with Policy No. 63 Town Board Remote Participation Policy, Chairman Cahalane announced that Selectmen John Cotton would be participating remotely due to geographic distance.

Motion made by Selectman Gottlieb to ratify the Agreement between the Town of Mashpee and Scott W. Carline, Police Chief and authorize the Town Manager and Board of Selectmen to execute said contract on behalf of the Town of Mashpee.

NEW BUSINESS:

Review Additional Articles Proposed for Fall Annual Town Meeting:

The Board of Selectmen reviewed the additional articles planned for the October 2015 Town Meeting warrant.  For informational purposes, the Chairman of the Board of Selectmen read aloud the proposed articles into the record.  Although the deadline to submit articles for the fall warrant has passed, the Selectmen have the ability to include or remove warrant articles prior to the posting of the warrant deadline.   The following articles were given consideration for placement on the October warrant;

Article 1:      To create the Historical Commission Revolving Account.
This provision would enable the Historical Committee to fund the account with revenues received from the sale of books related to the History of the Town of Mashpee.  Funds would be used to further the operations of the Historical Commission programs and services.  Expenditures from this account shall be limited to $10,000 for FY2016.

This article has been reviewed by the Finance Director and Town Counsel without objection.

Motion made by Selectman Cotton to include and recommend Article 1 for placement on the October 2015 Town Meeting warrant.

Review Additional Articles Proposed for Fall Annual Town Meeting: (continued)

Article 2:      To appropriate $350,000 from the Overlay Surplus to the Town Hall Repairs and Maintenance Account for the purpose of making improvements, including the purchase of various furnishing for the Archives building, the Department of Natural Resources and Town Hall.

Rodney Collins, Town Manager indicated he is awaiting state bid quotations, and the actual cost of improvements would most likely derive under budget assumptions.  Funding for the non-structural and much-needed items would be obtained from the release of Overlay Surplus funding.  Approval of this appropriation would support the replacement of worn, antiquated furnishings, some of which were previously donated.   Additional items include the purchase of fire proof safes, shelving and materials which would assist in the preservation and protection of archival documents from environmental factors.  

                Discussion followed with respect to utilizing the capital budget as an avenue for this type of expenditure. Capital items greater than $25,000 usually originate from the capital improvement program budget.  There was also concern regarding the funding recently expended for the renovation and protection of the Archives building.   It was explained the refurbishment would provide a tremendous boost to morale, and with respect to the Archives, improvements are slated for the storage of items in the basement area which was not included in the restoration project.

                It was agreed the Town Manager would provide the Board with a breakdown of expenditures proposed for the referenced departments and buildings for additional review.

Article 3:      To create (2) full-time positions, Director of Natural Resources and Water Quality Control Monitoring Technician within the newly organized Department of Natural Resources.  $107,826.10 is required to fund the positions from mid-November to June 30, 2016, deriving from available free cash.

                Within the reorganization plan, Richard York, the Shellfish Constable would be promoted as Director of Natural Resources.  This would create a vacancy in the Shellfish Constable position.

                The new Natural Resources Department would be instrumental in implementing the Shellfish and Water Quality Monitoring components of the Mashpee Comprehensive Wastewater and Nitrogen Management Plan in addition to protecting, preserving and enhancing the Town’s natural resources including shellfish and finfish populations.
                The project will enable the Town to continue with Phase I of the Town’s long term planning for nitrogen reduction.

Motion made by Selectman Gottlieb to include and recommend Article 3 for placement on the October 2015 Town Meeting warrant.

This position previously created, would provide for the continuation of work on the Local Comprehensive Plan and other duties, and permit the Town Planner to perform work towards the implementation of the Mashpee Comprehensive Wastewater and Nitrogen Management Plan.  To offset budgetary constraints, the $20,000 part-time Sewer Commission Administrator was removed from the previous draft warrant.

Motion made by Selectman O’Hara to include and recommend Article 4 for placement on the 2015 October Town Meeting warrant.

Article 6:      $32,000 to the Department of Natural Resources to fund a Monitoring Contract with the University of Massachusetts Dartmouth for examining water quality associated with Shellfish Aquaculture in Popponesset Bay and Waquoit Bay and its effectiveness in reducing water column nutrient concentrations.  This is the first year of a three-year analysis.

Review Additional Articles Proposed for Fall Annual Town Meeting: (continued)

Article 22:     Land Distribution Project; Tax taking properties identified as Town-owned land to be developed into public access parks, affordable housing, waste water treatment facilities if needed in the future, selling a limited number of parcels, and permanently protecting land as open space under the care and custody of the Conservation Commission.

                The article is a result of a 9-month effort to designate uses for public lands in the possession of the Town for which no specific use has previously been designated.

                An in-depth discussion followed with respect to this regard.  Acting under the Board of Selectmen, a working group spent considerable time to delineate the tax taking parcels.  There were several public hearings, and changes were made as a result of public outreach.  It is deemed a comprehensive approach to develop uses for the 283 parcels of land, most of which would remain in its natural state.

                However, previous town meetings have opposed any change to the tax taking properties.  It was recommended the Board gain further knowledge of the properties and their locations, and defer any action at this time.
                
Motion made by Selectman Gottlieb to include and recommend Article 22 for placement on the October 2015 Town Meeting warrant.

As the matter was debated, it was recommended the waste water component be included on the October Town Meeting warrant.  It was noted that Mashpee’s Comprehensive Wastewater and Nitrogen Management Plan identifies a number of parcels on the Land Distribution list as potential and future waste water site locations.  It was also noted this article was previously identified individually on Draft #1 of the October warrant.

Motion made by Selectman Gottlieb to include and recommend the Waste Water Article as follows; To see if the Town will vote to authorize the Board of Selectmen to use Town-owned land identified with the Town of Mashpee Assessor’s map-id designations 33-1, 33-2, 41-51, 42-17, 42-21, 34-2, 34-3, 33-3, 35-81, 35-82, 36-45, 47-26, 120-88, 45-68, 42-22, 28-88, 83-33A, 104-66, 76-120, for the purpose of developing waste water treatment facilities, and to authorize the Board of Selectmen to take such actions as they may deem necessary to implement this use, or take any other action relating thereto.

It was noted the Plan has been endorsed by the Sewer Commission.  
It was also agreed the School Committee would be consulted regarding the properties to be held by the Board of Selectmen at the discretion of the Board of Selectmen relative to the development of waste water facilities.  If there is opposition, the Board has the ability to indefinitely postpone the article on Town Meeting floor.

Review and Execution of the October 2015 Annual Town Meeting Warrant:           

Article 9:      $338,205 to the Information Technology Department Capital Account to fund a Digital Records Management System.  To purchase and implement a Laserfiche Digital Records Management System to facilitate access to files, reduce storage space costs, and improve information security.

                David DelVecchio, Information Technology Director was in attendance to review the project proposal with members of the Board of Selectmen.  Mr. DelVecchio outlined the costs associated to the Phase I purchase which includes software and image data scanning.
                
The project is proposed to begin with Inspectional Services comprising of the Board of Health, the Building Department, Conservation Department and Planning Department.

Article 9:      Digital Records Management System (continued)
Implementing the Laserfiche server software with the Records Management Module receives certification with the Department of Defense records and Records Administration.  

Mr. DelVecchio indicated that it is important to scan documents, certificates, and maps into digital form to increase access, security, and disaster recovery while eliminating document storage requirements.  The program includes support and maintenance.

                It was noted the Board approved a Compensation Study last year.  The Board of Selectmen requested a copy of the analysis which was prepared by Warren Rutherford of The Executive Suite.

Article 11:     $100,000 to the Sewer Commission Facilities Study Account to fund the hiring of an engineering consultant to complete the necessary studies and analysis as well as preliminary design necessary for the connection of various properties to the existing Mashpee Commons and Wampanoag Village wastewater treatment plants.

                It was agreed the article would be funded from free cash, and submitted by the Board of Selectmen.

Article 12:     $80,000 to the legal and engineering account to support the development of inter-municipal agreements with Falmouth, Sandwich and Barnstable regarding shared responsibility for the nutrient cleanup of Waquoit and Popponesset Bays consistent with the Section 208 Plan, and the negotiation and establishment of a Memorandum of Understanding and/or contracts for use of, acquisition of, and connection of additional properties to existing private wastewater treatment plants, and to develop and maintain permits and monitoring plans to ensure the Town is compliant.
                
                The article is a re-draft and combines previous articles at a reduced cost.  The distribution of funds shall be directly controlled by the Town Manager.  It was agreed the article would be submitted by the Board of Selectmen.
                
Motion made by Selectman Gottlieb to endorse and recommend Article 12 on the October 2015 October Town Meeting Warrant to be submitted by the Board of Selectmen.

Article 18:     $14,000 from the Waterways Improvement Fund Account to the Channel Permit Account to cover legal and engineering expenses to include a new proposed Popponesset Approach Channel Design Permit to be added to the new Town Comprehensive Permit.

Motion made by Selectman Gottlieb to endorse and recommend Article 18 on the
October 2015 Town Meeting Warrant.
Motion seconded by Selectman O’Hara.
VOTE:  Unanimous.  5-0.

Article 21, 22, 23:     Zoning Bylaw Amendments as recommended and submitted by the Planning Board.
